Subject: collection notice: long story, need advice!!!

The backstory:
I have 2 houses. I have had home owners through all-state on house #1. then we bought another house and requested a quote from them to cover house #2. Well, then they increased the policy for house #1. Called them, and they quoted approx. $450 for each house for a year. Then, I would get policy notices in the mail saying they were $640 & $880. Called them to have them fixed. This went on for like 4 months. Finally, we got tired of trying to "get it taken care of" when they billed my mortgage company $1200 for House #1 & I called and told them to cancel my policy on house #1 [never got policy on house #2]. Went through a different agency.
THEN:
They refunded the money for the policy & i kept getting a bill in the mail for $118. Called them and told them that we werent paying it because we arent even on their policy. The told me I had THREE policies: 2 policies on house #1 and 1 on house #2. We were only aware of house #1 having one policy [that was supposed to be canceled] and then house #2 shouldnt have been under any policy with them.
NOW:
Today, I got a collection notice from a collection agency for $118. I'm worried that this is going to impact my credit report, but I refuse to pay them because I never agreed to the terms of their policies because they quoted me one thing on the phone n then something else in the mail. THEN the lady tells me oh there will be another collection notice coming out for $128 for your other property as well. I'm not paying them. I'm not. This has been an issue since July! This is their error, not mine. I'm not paying for something I never agreed to in the first place & I never signed anything to obligate myself to any of the policies.
The collection notice i got today said i have 30 days to dispute it in writing. HOW do i do that?! Any other tips/advice i should know. Allstate told me they would have the regional manager call me regarding this either on Monday or Tuesday. I'm so worried that THEIR errors are going to negatively impact my credit report!

Hi marcusandila,
I believe I would send them a debt validation letter asking them to send you proof the debt is yours. I know every time I have gotten a policy I had to sign something. And then I would get a copy of it in the mail. But since neither has happened with you. I don't think you should have to pay. |

thats what i thought. i just dont want this as a negative marking on my credit report. its not even my fault. n im not just going to pay em to get it over with, because i dont owe them in my opinion. honestly, why did they refund me if they thought i still owed them. you know what i mean?? because i got the bill for 118 before they even refunded me & i talked to them about it.
i guess i'll look through the forum, im sure there is something about debt validation letters on here, like what to write in them. should i send them to the collection agency or to allstate corporate or the agency that created all these issues. will it show up on my credit report as this "debt" being disputed? |

| I believe when you convince them that you are right. You need to tell them to remove the negative listing from your report. They shouldn't have reported it in the first place. Do you have any proof that they refunded your money? |

thanks justin for the advice and for the link to the sample debt validation letter. im just so worried about it because its one simple thing like this that isnt my fault that can ruin all the hard work i've put into establishing good credit for my future.
is it even LEGAL for them to try to collect payment from me? Given the circumstances? The regional manager DID call Marcus about it. Then he said he'd call back after he looked into it more. But, he never called back & marcus left him a few voicemails. I think he's trying to avoid the situation; which only makes me MORE mad. I can honestly say that i will NEVER deal with allstate again. i'm not going through this all over again. |
