Got a letter from a debt collection agency, answered the summons, showed up in court on the day of the bench trial, when my name was called, answered, they never showed up. Case & any law counterclaims were discontinued without prejudiced & without costs to either side. What does this mean, & why didn't they show up especially after all the threatening letters about suing me.

I will be calling the collection agency in a few days, I am preparing and doing my homework. Here is what I have so far.

Background: Owned an investment house, foreclosed in a recourse state.
1st lien took house, second lien sold their note to a debt collection agency.
I owe approximately 90k.
Agency has had the note since Jun and has made no attempt to reach out to me.
I have sent them letters stating I would like to settle for an amount but haven't heard back.
I called earlier and they are ready to negotiate when I am.

The back-story

I was laid off permanently in April 2009 & live in an area where the job market is pretty scarce. [800 applicants for a minimum wage sonic position  ] I have been searching for a new position since I was laid off; with no luck due to better applicants with degrees. Honestly, I want 2 Full-time jobs...but I have to find the first one before I can get 2!!

Senior unable to pay debt

I'm 78, divorced, self employed with a credit card debt of $25,000. The only verified income that I have is my social security of less than a thousand a month. Business has been poor so no reason to continue my business. Home valued at $178K, balance is $266K.
I don't have any assets. What reason do I have to file BK. I'm probably not going to live long enough so what do you suggest I do. Ignore all creditors, keep only cash on hand, close out my business and just ignore phone calls from creditors?
