My elderly father was married and his wife left him when he started to go into kidney failure. My sister and I decided it would be best to have a power of attorney so that we could manage his healthcare and if he needed to go to a nursing home - take care of that. About 6 months after he died both my sister and I got a letter from an attorney for from the mortgage lender for his property (land and a mobile home) stating that we may be interested parties and wanted to let us know they would be auctioning his property. We called the attorney and let them know we were just power of attorney; he had no money when he died and asked to be sure they weren't trying to hold us responsible for his debt. They assured us that wasn't the case and we then also sent a letter stating that. So now it looks like they are trying to hold us responsible....we both pulled our credit reports and have judgments against us from the mortgage lender. As background my dad couldn't live alone so he moved from NM to TX to live with my sister. He had no will, life insurance or any money so we didn't have anything to pay his mortgage with. His wife wasn't on the mortgage and she will not communicate with us so there is no way to find out if she has a judgment against her as well. How can they do this? We are just sick with worry about this being on our credit!
