Wage garnishment - What is it and how can you stop it?

If you're unable to pay your debts on time, your creditors or collection agency may file a lawsuit and win a judgment against you. Then, if wage garnishment is legal in your state, creditor or collection agency (CA) may have the judgment enforced through a wage garnishment. A wage garnishment is where the creditor or CA contacts your employer and requires him to withhold up to 25% of your wages to satisfy the judgment, depending on your state's law.

How can you stop wage garnishment?

Once a wage garnishment order has been granted, it is difficult to reverse it, but not impossible. If you can't manage to pay your basic living expenses while your wages are garnished, then you should collect a "Claim of Exemption" form from your local courthouse and file it with the court that issued the garnishment order. You should also request a court hearing and object to the garnishment to explain your situation in detail. On the day of the hearing, you'll need to show documents regarding your income and expenses so you can convince the judge that the garnishment will adversely affect your financial situation.

If you don't contest or fail to contest the garnishment, you can either pay off the judgment amount in full or negotiate a reduced payment with the court. If your state's garnishment law imposes a lower garnishment amount, then the court will follow the state law when imposing a garnishment order.

While your wages are garnished to satisfy the judgment, a lien is placed on your assets and property and it'll remain until you pay off the judgment amount. If you sell your property, the sale proceeds will be applied first toward the judgment and then toward any other debt.

In some states like Michigan, a garnishment order expires after 3 months. Therefore, a creditor or collection agency needs to obtain a new order for garnishment 3 months after the first order has been issued. This gives you some more time to work out a payment plan with your creditors/CA or challenge the amount being garnished.

What's the best way to avoid garnishment?

If you think your creditor or collection agency is taking steps to have your wages garnished, the best way to avoid it is offer a payment plan you can afford.

The best way to avoid a wage garnishment that you can't afford, after you've been served, is to answer the complaint within your state's time limit and appear in court on the appointed day. This way you will be able to present your case to the judge before the judgment is issued. You will also be able to present the judge with a statement of your finances that will help the judge determine how much the creditor or collection agency may garnish.

You can also try to negotiate with the creditor or collection agency before judgment is granted and get them to agree to an installment plan. Dealing with the creditor, collection agency, and the court before the judgment is granted is easier and more cost efficient than attempting to appeal one.

What if the IRS files wage garnishment?

If the IRS has a wage garnishment order issued against you, contact them within 30 days of receiving the Notice of Intent to Levy, and come to an arrangement with them to prevent your wages being garnished. You can try for any of the options stated below to stop wage garnishment being enforced on you:

  • Pay the debt in full: Here, you pay off the entire amount you owe including the interest and the penalties you've incurred. If you don't have enough funds, consider borrowing from your family or selling your assets to pay off your tax debt. If you don't find this option suitable, try settling your tax debt with the IRS.

  • Offer in Compromise to settle taxes: Under this agreement, the IRS agrees to accept a payment less than what you owe on your taxes.

  • Installment agreement: This is where you agree to pay off your tax debt in monthly installments over a 3 year period. If you owe $25,000 or less in taxes including your interest and penalties, you can apply for an installment agreement online. However, if your tax debt exceeds $25,000, you need to fill out a Collection Information Statement, Form 433F, and mail it to the address stated on your tax bill, along with the Request for Installment Agreement, Form 9465.

this is not an irs garnishment it is a credit card garnishment while in the military in 2002 can it be stopped as I think it was paid an had no idea they were garnishing wages saw it on my pay stub today. No court order was established

A judgement was awarded against me through the court for me to pay $1000 for a credit card that had a $500 limit bit failure to pay it incurred to that amount. I agreed to pay monthly paymentson the $1000, I paid the first $400 then I could not afford it, now they are garnishing my taxes for the full amount of $1000. So the $400 I did pay towards the $1000 doesn't show up, I feel like am getting taken advantage of someone please help

A few years ago, there was a sheriff's lean put on me through the courts because of a defaulted credit card. I ignored it because I was not employed and had no means of paying. I have since graduated and will be starting my career. I do not want a wage garnishment to pop up and scare my employer. I need to get this settled. My question is, how do I go about this? I have tried contacting the courts but they seem to not have any records of this lean and yet it shows up on my credit report.

I owe $118k. I have had a garnishment on my wages since 2007. It is 25% of my salary. I find I can no longer pay rent and utilities in full every month and have no disposable income for food and fuel. I would like to know more about this "Slow-Pay" option. I would be filing in the Northern District of Illinois (orig case location). Can you help? I would do this pro se, I just need to know what to file, when and to whom. Thank you!

I have recieved a court summuns from Tulsa OK for a credit card debt i acquired in Texas. I am currently renting and working in OK i have been for 2 years. Before that i lived in Texas I still have a Texas divers license and concider that as my permanent home of residence. In Texas credit card companies are not allowed to garnish your wages but they are in oklahoma my question is can they garnish my wages just because i have moved to OK when the debt was incured in Texas.

My divorce attorney turned by debt into collections, and I have been making payments but they want way more than I can reasonalbly pay, basically they want one whole paycheck a month. so they say they will garnish me and take 25% if they do this, I will be living on the streets with my kids. I have sent them finacial stuff to show that I can't afford, anymore and I asked if they would settle for half the debt, they refused. I am not sure where to go frome here.

wage garnishment was issued on me and to my employer. I didn't contest. I had a big situation happen to me towards the second half of last year and then I made a bad decision. I paid more on this debt than I didn't last year. I think I missed 3 payments. As I know this is bad it is what it is. I want to make payments and have wanted to make my scheduled monthly payments since December. In January I was issued this and they told me they couldn't take any payments. So it it near end of February and nothing has happened. I want to pay and no one wants my money. I really want this to disappear but I can't afford to pay the whole debt off. I want to get back to my monthly payments and swear there would be no lapse in payments. I am in a better situation this year and want to give them money. I never thought I would have to beg creditors to take my money. Any suggestions

I have been issued an motion to attach wages hearing from the State of Rhode Island but I have been a resident of Massachusetts my entire life. My Wife and I split and she moved to RI but I stayed in Ma. In Ma. SOL is 6 years, RI is 10 years, hence why they are trying to get this done in RI. They told me I already have a judgement against (in RI) I plan on objecting on the ground of I am a resident of Ma. and never a resident of RI, so I never received any notice in regards to this judgement. I called the collector and told them I am a resident of Ma. and they said it did not matter because they already have a judgement against me. How can they legally have a judgement against me in state of which I am not a resident? Any advise would help because I will not have a lawyer. Prove to the judge I am a Ma. resident and by Ma. law they must win the case in Ma. first before domesticating to another state?

is it possible for an unsecured creditor to obtain a garnishment order against me even though i told creditor that i am in the process of filing consumer proposal with help of legal trustee. i have already signed some documents and made initial payment of $600 with understanding of regular monthly payments for specified period pending creditors approval which trustee assured would be accepted. i informed collections for creditors of the proposal but they all said that they did not receive any notice from trustee . i gave name and number of trustee but one creditor did not need to have it because he says it takes 4 to 5 weeks to file. my major question is whether it is possible for that creditor or other to obtain garnishee order before proposal is legally filed by trustee.

I just recieved a letter saying that my wages were going to be garnished. This is my first time with this. I am nervous. Hubby and I are trying to buy a house, our credit scores were low to begin with. How bad will this affect our scores? I feel like crying. We try so hard and seem to be getting nowhere. I recieved a lien to garnish my wages from a creditor. Actually my wife had leased a car to own and had it for 24 months of a 36 months contract. so they repo it because she could no longer afford it. A few years later my wife recieved a call from a car dealer stating that she owes the same amount the contract she signed but she payed the car for 24 months and they told her that they sold the car but did not say how much. I quess my question is, Do I have a legitimate reason to file for a counter suit?

I live in the state of Washington and my garnishment paper I got said 1099.58 monthly exemptions amounts for continuing lien on earnings I don't even make that a month...the full amount of what they are going for is 2207..If I don't even make 1099. a month how can they take my full check...I maybe make between 900-1000 a month...
