Would my husband be responsible?

Hi, I need ur help. I have been served a summons by Chase bank. I owe 12k on 3-different CC's in my name only, but I'm married. Can they come after my husband's wages or property?

No.....if the CC's are in ONLY in your name, they legally cannot go after your husband, too. Just curious: have they said they would "attach your bank account" to pay the CC's back? If they DID say this, and you and your hubby have a bank account together, you may consider opening an account in JUST your name, so they won't 'attach' your hubbys account, too. Just a thought.

Hi ndamner,

Welcome to this community :)

What sdchargers said is true. However, if your's is a a community property things may be handled differently. In a community property state both the husband and wife is held responsible for the debt incurred by the other during the lifetime of the marriage. So let me know the state you live in.

Thanks,

Aaron

Hi ndamner,

I think you had forgotten to log in :) Well, yes California is a community property state. Thus, your husband can be held liable for the debts incurred by you during the marriage.

Thanks,

Aaron
