Today I was served papers from a credit card company requesting a court appearance on 9/30. Currently my attorney has been attempting to settle with them.

Question can the credit card company force you to sell your home to pay off debt in the state of Illinois?

Would they instead garnish wages?

No, a credit card company cannot force you to sell off your home so that you can make the payments. However, if they win a lawsuit against you, they can garnish your wages in Illinois. You can check out the Illinois wage garnishment laws from "http://www.bcsalliance.com/debt1_illinois.html".

They can also put alien on your house. That is until you pay off the debt, the lien won't be removed and until the lien is removed you won't be able to sell your home.

However, as you were served the papers, answer to the summons within the stipulated time, and if possible try to settle with the creditor.

they can put a lien on your home which does not force you to sell but it means that they will collect the money before the deed can be transferred in a sale. so you don't have to sell, but you can't sell without paying the debt.
