I received my CA dv letter's return receipt on 7/9/2010, can I send dispute to CRAs now or wait 30 days to see if I get response from CA??

Also, dispute to CRA has to be CMRRR or just certified??

Please advise.

Hi fantoos,

Yes you can do that. You can immediately send in the dispute letter to the credit bureaus. This is known as the 1-2 punch.

When you send dispute letters to credit bureaus immediately after receiving the return receipt, the collection agency (CA) will be put in a time crunch. After getting the dispute letters, credit bureaus notify the CA of this. The CA will have to verify the debt within 30 days with the bureaus. Else, the debt will be automatically removed by the credit bureaus.

However, the CA can't verify the debt with the bureaus directly before validating the debt with you. Else, it will be a violation.

Thanks,

Aaron

Thanks alot Aaron..........

I'm not sure the the collection agnecy I sent the DV letter is the right one or not....the negative tradeline on my credit reports is showing by original creditor .......no collection aganecy name or info is listed on any of the report except TransUnion has one extra piece of info besides OC's name and address is a toll free number. I called that number and they are Vengroff, Williams & Associates, they have multiple locations including California (OC was in california too but out of business now) Every time I called that number I'll be on hold for like 30 to 45 minutes no live person ever came. So I just assumed that Vengroff, Williams & Associates, California branch reported the negative and sent DV letter to them. Now I did some more research and found out that they are more of a commercial collection agency. Most of the company's service business is B2B collection.

If they are not the right CA on my debt?? Can they come against me??

Copy of Return Receipt from CA that I sent to CRA, that has Vengroff, Williams and Associates name can this make my dispute frivolous??

AARON...........I've 'disputed' a few things on my CR, sometime last year. When CA's DO verify the debts, with the CBA's, sometimes I think that the CRA's need to REALLY investigate if the debt is valid. I mean, the CRA's just take he word of CA's, without REALLY looking into it..ya know? A CA can send them any old thing. What about CA's that 'represent' PDL's?....If PDL's are ilegal in MOST states, how can the debt (that the CA says 'we' owe) be legal in the first place? That's something else I have on my CR. I tried to 'dispute' this issue, with the CRA's, however....they came back and said the "debt was valid." Makes ya mad as hell!!!!!!!

Hello All,

Thanks to all who helped me to remove negative tradeline from all three CRAs. I pulled all three reports today and verified negative entry is gone, however on Tansunion(only) I see the same account with different $$ and date as 'Closed' status and instead of showing Closed as 'Agreed' it is showing Closed as 'Unrated'. Not sure what 'Unrated' means. And yes... it is being reported by same OC name with CA phone number.

Please advice do I need to worry about this Closed Unrated account ? Also how long a closed account can stay on credit report?
This account shows was opened in 1992 closed in 2006. But in actual this account was closed in 1994.

(Just a thought here..) It would be nice if ALL 3 CRA would know what each other is doing. I've disputed items, with all 3 of them, however..there were times where only 1 or 2 would respond. And then, I would have to dispute, AGAIN, to that one, that didn't respond. Also..(I think I've read this on the Forum, somewhere..) if you dispute itmes, your credit score goes down. I don't know about that, thought. It's almost like 'the right hand doesn't know what the left hand is doing' kind of thing.
