Received Notice of suit

I received paperwork today from a attorney's office. States that they are representing a credit card company and a suit is being filed against me. Here is the thing. There is no case number or docket number provided on the paperwork and when I contact my County Clerks office they said they do not show a case against me. The attorney's office wants me to give them my banking account info to show good faith that i will agree to make payments to them without receiving a consent letter stating balance owed and monthly paymetn info to stop the civil suit. I refused to give them that information. I am at a loss on what to do. Is this a scam or should i respond with a validation letter to make sure this place actually owns or is representing the card company.

Not sure what to do at this point.

If it was a real case it would be filed at the courthouse and definately have a docket number, this is a ploy for them to get your bank account information. Do not give them the information. You need to do debt validation but you also need to address the fact that they were using false court documentation threats to encourage you to pay. This is against the law, you need to contact and file a complaint with your attorney generals office.

I am not sure who you could file with federally but I am positive that some one here will know, this is a pretty big violation of the federal debt collection laws. Hang out and see what others have to say.

I would not give them any information especially bank account information if what you are saying is true, no docket number and no case number.

THANKS IT IS JUST WEIRD BECAUSE THE SHERIFF OFFICE DELIVERED IT. I CALLED THE CIVIL DIVISON AND THEY COULDNT FIND ANYTHING. BUT AFTER SPEAKING TO STATE DIVISION THEY DID HAVE A CASE NUMBER. SO NOW I HAVE A CASE NUMBER SHOULD I TRY AND MAKE ARRAGANMENTS TO PAY SO THIS DOESNT GO TO COURT? I KNOW I OWE IT BUT COULD NEVER GET A STRAIGHT ANSWER ON WHO WAS COLLECTING FOR THE COMPANY.

You should not give out your bank account information to this attorney office. They must be a scam. If you think that you have any such debt as mentioned by the attorney's office, you may try debt validation. However, if you are sure that you owe no such debt, you need not send any debt validation letter.

As for the complaints, as this is a Fair Debt Collections Practices Act or FDCPA violation, you can file complaint with the Federal Trade Commission. You can also file a complaint about this with your State Attorney General.

Thanks.. I was served by the sheriffs office and did confirm with the county on a case number. The attorney's office (Pollack & Rosen P.C.) have agreed to work out payment arrangement. I am suppose to go to there office tomorrow and work on the paperwork which they call a consent letter basically from my understanding i make montly payments but if i miss one payment they will have the right to garnish wages and or put a lien on my home or business. Does this sound right? I am so confused and not sure of what to do. I just want to make sure if I sign the consent they will not take further action nor start garnishing wages.. Should i also file a answer with the court letting them know we are trying to work out arragements?

Hi,

As you have received paperworks from sheriffs office, you need to answer to that, though you are settling the payments out of court. Get the agreements in writing, before starting the payments, so that they may not deny that you have made the payments.
