Debt Collectors has not answered my DV Letter, what do I do next?

Once they have not validated the debt you can file a dispute on the entry that they have posted on your credit report or credit reports.

Make sure that you have copies of everything because they may say that they did not recieve it. Hopefully you sent it all certified, return reciept requested right? If not, you may want to do it again and make sure that you do it certified this time with a return reciept requested.

Is this on your credit report?

1. check all of your reports at https://www.annualcreditreport.com/cra/index.jsp

2. dispute this CA if it appears on your reports.

3. if the CA is not deleted from your credit report then send a MOV Method of Verification letter along with a copy of your attempt to contact the CA directly. ideally, you need proof of postage (CMRRR)

So if it isn't on your report or it gets deleted that's good. It is one of the normal reactions to receive no response. By law they can't pursue anymore collection activities until they respond to the DV. Sometimes it takes a while, sometimes they just go away. But another CA might pick up the case.

disputing online is a waste of time.

I am sure you want this to go as fast as possible but dispute the CA in writing. Which credit report is this on?

I sent a DV letter via cert. mail over 30 days ago with a return receit card, which I received with no reply from collection agency. I saw a Chg off on my credit report from creditor not collection agency. I want to dispute to credit reporting agengenies and sent another letter to collection agency that they are in violation. What do I write???

The collection agency is not in violation, as they haven't listed this on your credit report (to your knowledge). Check all the credit reports.

It is normal for a CA to not respond. Sometimes they don't have any evidence, and sometimes it just takes a while for the OC to send DV to you. You see what is happening is that:

1. CA receives DV and stops collecting
2. CA tells Original Creditor
3. OC sends DV to you
4. CA starts collecting again

I would go ahead and dispute the OC, and maybe send a 623.

Hi beagletrixie:

You can try for a second validation. Send the letter through certified mail, requesting a return receipt (CMRRR). If the collection agency fails to answer this time too, you can dispute the item off your report. Send CMRRR dispute letter to the credit bureaus, attaching with the letter a copy each of both the validation letters. Mention that the collection agency did not answer to your validation request. You will get a sample dispute letter at http://www.creditmagic.org/repair/dispute-letter.html .

Guest:

Zwicker associates do act in Florida. As far as I understand Zwicker can try to collect from Florida too.

Hope this helps.

Aaron

LOST (not verified)

I have 4 of which are behind or charged off and sent to collectors. When I moved to another state I set up my phone svc and the first call I got was from a collection agy which named one of the pdl's instantly I set up a payment plan. Later the same day I realized wait a minute I have not given my number out and began to believe it was a scam and called them back requested a letter validating the debt and original loan co with a address to send payment and was told no. I have been hounded ever since and even my family have been told there is a summons for court which I have never recieved but they tell me my address on the phone messages and where I work, but i have received nothing in the mail from anyone, only phone msgs threatening that the authorities are coming out and I will be going to court or be arrested for fraud. I have had different calls different case numbers and I don't know if they are all for the same loan company or others.. LOST.. How do I get a DV when they wont work through the mail??
