I was out of the country for 5yrs. when I got back I had a judgement from my creditors... can they put a judgement on me even though i was not present in court? NY State

Hi Imlerato,

The creditor or the collection agency must have send you a letter before suing you? They may even have sent you the judgment dates too. If they have sent you the letter mentioning that they are going to sue you, they can get a judgment against you. However, it depends on the state laws too. You can go to the court and check the details of the judgment filed against you.

Moreover, I think that it is a default judgment, as you have not appeared in court. Thus, you can contact an attorney to deal with the default judgment.

I have heard as long as they make reasonable effort to contact you then they can move forward. Is this true? Poster, maybe someone else signed for your letter and did not make you aware of the court proceedings. I have also read a relative can sign for a registered letter.
