In PA, what can be taken as part of a CC judgement?

If a creditor wins a judgment against you in PA, what assets can be taken? Can they inventory your home and sell your belongings? When can/can't they lien your home, how much equity do you have to have before they can take it? What about cars? I have ni idea.....

You may be summoned to court to arrange for your creditor's payments. However, you must make sure that the agreement you come to with your creditor must e affordable by you. Besides, you might also have your wages garnished, to a certain percentage only though. But before your creditor can get your wages garnished, he has to give you a notice of the garnishment which would include:

* a statement of garnishment
* a list of exemptions from garnishment (list of what your creditor can't claim)
* description of how you can contest the garnishment.

You will have a chance to prove or explain in court why your wage should not be garnished.

Your creditor may also get another court order which will require you to appear at 'supplemental proceedings' where you will have to answer questions asked by your creditor regarding your bank accounts, wages earned and any other property they have knowledge of.

Your creditor, however, won't be interested in garnishment if they know that you have nothing worth to pay back the loan.

Hi Carol,

Thanks for the reply. I live in PA so I am pretty sure my wages can't be garnished, however, I am concerned about things like our cars (2) and personal belongings in the house. can they take that kind of thing or just put a lien on the house?
