Credit card and judgment.

I am 62 and have been unemployed for a year. My husband is now also unemployed. We are scraping by with little UI trying to pay our bills, hoping we will find work in the very near future.
A credit card company took a judgment out again me though I did not receive any information saying a court hearing had taken place.
Today my bank account consisting of less than $100 was wiped out and left me with overdraft fees from consecutive debits. My name was also secondary to another bank account belonging to a friend who has two young children to take care of. That account was also wiped out by the credit card company. In her account she had $1500 from a government loan to pay for her college.
Is there any way my friend can retrieve the college money from the joint account?

I don't think so, when you are on the account as a joint owner it is joint funds.

She may have a shot if she goes to the bank and can prove that it was her deposits then the bank may be able to recover the money through their dispute process, it is certainly worth a shot.

They will continue to do this until the bill is paid, so your freind may want to open a new account in her name only and have her money sent exclusively to that account.

Goodnatured is correct. What I do not understand is how a judgement was placed when you were not notified to appear before the court. Usually a registered letter is sent to you. I would go to the court house that placed the judgement and see why you were not informed of this date. Does anyone know how a creditor gets a judgement when the defaulter is not notified?
