I recently checked my credit report and i found a check that was posted as a NSF for $79.00. Now the debt is at $391.00 with fines and fees. I had no knowledge of this debt due to it being posted only in June 2009.

The date the incident happened was in 2001 and the infraction will be removed on 12/09. I have spoken to the collection agency and asked for documentation of this bad check and they said they will send it out.

Since my first conversation with them which was over a month ago they have yet to send me proof of this debt. They called numerous times and said they will send it out first thing.

My question is since this is coming off 12/09 and they can't prove this, should I pay it. The debt has been disputed with the credit agency.

I would not pay it, if you do it will it will start the statute of limitations all over again, It is totally up to you, but if it were me I would leave it alone.

See what results of the dispute, if they can prove it to you then they won't be able to prove it to the credit reporting agency either, just let it ride and see what the results are. I would also check the other two reporting agencies and see if it is on there too.

Hi Wendel,

So, they are unable to provide any documentation that will prove your debt. Anyways, you said that it is going to come off in 12/09, then I believe you can decide against paying it. However, saying all that, I would definitely suggest you not to repeat such things in future and maintain a healthy habit of paying the debts on time.

I don't even believe i owe this debt. I did dispute it and I am awaiting the documentation that this debt exsist. They only reported it to Trans Union. It was never on my credit report before and just was reported on 6/2009.

Also have you called the bank which reported this and enquired with them

All the CA does is they send them a letter askign for explination or clarification

If they can tell them, then they will tell you for sure

Always pay your debts as quickly as plsisboe as this reduces the interest you pay at the end of the day. Some credit purchase will have actually doubled in price by the time you pay it off on the lowest payable amount.
