I got a credit card about 10 years ago. After a while I couldn't make payments. I am on disability now and want to pay it off. I was contacted by CSR and they wanted to settle. The problem is I gave her my account number to my bank account. I asked her to wait until the next month but she didn't want to wait. To keep her from messing up my account I closed it. I still want to pay off my debt but I can only afford so much a month. I live in Alabama and she said she could hold up to 30% of my check, also she threaten me with Federal charges.Can she do that? Whats the best way to pay this debt, because someone told me not to contact the original creditor because they will just say it's out of there hands. I want to clean my credit up, but I tried to get a credit report and it never came. I am still married so my name changed ,could that be why my credit report did'nt come. I need my credit report, but haven't had any luck. What can I do to get my credit back on track. What would be best for me. Consolidation, credit counseling? Help!

First I would check the SOL for Alabama if it has past then they can not try to collect from you. If it has you need to send them a letter stated that it has past and they can not collect on the debt.Make sure to send it certified so you will have proof they got it. And another thing if its been 10 years since you got it I would think it should be ready to fall off any way. If you haven't received your credit report I would call where ever you requested it from and figure out why and get one. Do not pay anything on the debt because if you do then the SOL starts all over again and then they can collect from you. Getting That credit report is the first step you need to take.

Ross, NEVER giv e a collection company your personal banking information. Even if they promise not to take any money out until the following month most will do it immediately. They do this because olnce you make a payment it resets the statute of limitations on collecting the debt. More than likely the debt was already past the SOL and you making this payment not reset it.
Also if your only source of income was Social security they lied becaus eit CAN NOT be attatched.
I would call your ATTY general and tell him that you was forced to pay because they threatened to attatch you SS benefits for 30%. This may get you freed from repaying the debt since I am pretty sure they violated the FDCA laws.
