My 85 year old mother inlaw has a sears visa card and her granddaughter got her to let her put a $3300.00 charge on it for a car and has been paying only the minimun payment for 2 years and she has only paid about 500.00 at this rate it will take several years to pay it off. there is nothing on the card to say that the grandchild owes anything so it is the grandmothers debt. she only draws social security $670.00 a month and cannot afford to pay it if she defaults
will this have to be paid out of her estate when she dies.
the only thing she owns is her house.
she lives in kentucky and i would like to know the law on this
thank you very much

If at all possible I would see if the granddaughter could get a loan and pay off the debt. Because I do believe they will put a lien on the house. And whoever ends up with it will have to pay it. Is the title in her name only? And the statements your mother inlaw gets each month should show where the payments are going to. Not sure if that's enough proof though.
