It is a collection agency and has a very bad reputation in the industry with the way they service the accounts.

If they are claiming they have your account then first of all you need to know if they are having your account details in a legal way. Request them to validate the debt so that you can be sure that the actual creditor hired them for the collection.

Know more about the validation process from this page - http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm#809

I need to find out if lvnv is trying to scam me. They have listed on my credit report that I owe for an MCI phone bill. I have not been able to contact them with the 1-800 # that I have. Also A Co. called CBE had me listed for the same MCI bill. I contacted CBE and they told me that they had no record, the account was purged, and to tell the credit bureau that. Have you contacted MCI on this issue, you may want to write to MCI, they are the original creditor in this case, often times old past due bills are past on from collector to collector in an effort to get the money, seems like the more they are past on the sleazier the collection efforts get. Are they contacting you? or did you just see it on your credit report and start to question it? How old is the bill? It may be out of the statute of limitations and be considered uncollectable. What state are from? This will allow you to know what the statute of limitations are on the bill. Please answer and I will attempt to look that information up for you. goodluck with this, they can be a pain.

Hi Jeanne
LVNV is itself a collection agency who might have purchased your debt and since after purchasing the debt, it becomes the legal collector of your debt, it has the right to sue you to recover the outstanding debt amount. If they threaten to sue you to the court, you should send a debt validation letter by certified mail with return receipt at once. Now if they validate your debt, it means that LVNV collections actually has the right to collect your debt and so you can come to a settlement plan to pay off the debt.

Hi Saifur
Since, it has not gone for default judgment, you should immediately file a response to the summon within 21 days of your receipt of the summon else the creditor can bring a default judgment against you and can garnish your bank account so that whenever any money gets credited in your account, they can take it away so long as the debt is paid in full. You can also include a motion to dismiss the case when you file the response.
