Subject: Is it possible to settle debt after summons are served?

I have received court summons for a CC debts. I have 10 days to reply to it. But I just wanted to ask that is it possible to settle the debt now, before I appear in court. Will the CA dismiss the court proceeding if I pay? I just want to get it straight without having to go to court.

Hi Ms. Barker,

There is no harm in asking the collection agency to settle the debts, even if you have already been served with summons notice. Collection agencies would also want to settle the matter out of court, as there is a fees involved in court proceedings.

Even if you are able to set up a settlement plan with the CA, you should file a response to the summons. You must tell the court that you are already making payments to the CA. It is most likely that the court will dismiss the case.
