rude collection agency

I am dealing with Brachfeld and associates. They call themselves a law group. Anyway-- I owed capitol one $3500 and settled with Brachfeld for $3000. They sent me a summons and then after that we reached a settlement agreement. I paid $1500 up front and agreed to pay 250 a month.
They accepted the 1500 and then went to court and filed for a default judgment. Luckily I put in the response on time and now am waiting for their answer. Now they are calling me and telling me that I need to make the 250 dollar payment by credit card or they are going to take me to court and get a judgment. Do I have to give them a credit card payment?

First of all can you tell me whether you have received the settlement offer in writing or not. If you have received the settlement offer in writing, where they agreed to settle for $1500 upfront and $250 monthly payments, I think that you can make the credit card payment. But if you have not received it in writing, ask for the settlement offer in writing first and then pay.

I agree with Carol. You should always get the settlement offer in writing because the CA after receiving the money may sell off the remaining portion of the debt to another CA and you will not have any proof to prove that you have settled with the Collection agency for less.
