I just got a call from Nationwide Cash from this attorney named Mr. Mitchell and he told me that they are going to take legal action against me because I wanted to move back my payment for one week! That is it. I don't know what to do about it. He told me to hire a lawyer because I need one.

I have taken on the PDL industry because Mr. Mitchell at nationwide said he would send the sheriff out for me and told me I needed a lawyer also. He is full of hot air and there is no such thing as debtors prison. If you have his number call the fool back and give him the phone # for your local police department. You cannot go to jail over a debt, that is all it is, a debt. see my blog in regards to my cause and don't give him any bank information, in fact close your bank acct tomorrow and open a new one or the PDL will bleed you dry. I have a PDL company that is harrassing me, because I closed my acct (I have paid well over the borrowed amt). They say they can take legal action because it's considered the same as writing a bad check?? Is this true?

Hi Trina,

Figure out how much you have paid on the account and the limits specified as per state laws. Then contact the company, show them all the details and ask for a written "Paid in Full" letter. You can put your complaint with FTC, Attorney General of your state and BBB against the harassment.

They can only take legal action if you had defaulted but as you are saying this is not true and you have actually paid more.

If the attorney for the company is making threats of suit with no intention of filing, then there could be liability under FDCPA. I'd be interested in hearing more about this situation.
