I am being sued by American Express! I need help.

I have been reading this forum for a couple of days now and the information here has been great.

I received several letters from lawyers saying that a suit has been filed against me. I called the court and they said they did not know when I would be summoned. I need help! I have started to compile a debt validation letter that I will send tomorrow, but I want to know what I need to do/or can do before I am summoned to help my case. I live in Texas and the debt is relatively new/less than a year. Any help you all can offer me would help me trmendously.

If you are being sued did you get the summons by mail or did the sherriff serve you. I had mine served by the local sheriff who told me to go to the courthouse in person and file a counterstatement rebutting the suit. This was an old debt by citibank. You need to ask for validation of this debt by certified mail first. Send it tomorrow, and take it to the courthouse(a copy) of the letter and the certified rcpt with a signature recpt and dispute the validity of the debt. If you really do owe the debt, then I suggest you contact your creditor with a pay for delete letter to buy you some time. See examples on the left under letters of credit. Its a slow process, but it will work. The people here helped me a great deal. I hope to help all as well. One good turn deserves another. Hang inthere. By the way, one thing I learned right off the bat on this site, NEVER TALK TO A CREDITOR ON THE PHONE.They will twist your words. Do what I did the other day. I had one call my sons house and I just happened to be visiting. They wanted to talk to me, and lo an behold I answered his phone. Startled I asked who it was and they just started in on me. I told them to whoa that I wasn't Ruthie, That I know her and she is a relative. I told them that she will not speak to anyone on the phone, and they have to send her a letter instead. Thats the only way. They argued but they finally agreed. Try it for the annoying ones. Then when they contact you by mail, answer them in writing by certified mail.
