Collection agency reporting for old debt

Hello all,

I got a letter around August 14th from a collection agency for an old debt from 2003. I sent out a debt validation letter on August 19, 2010 via CMRR. I have received no correspondence from them since. However, on September the 4th, I received an alert from my credit monitoring service that the account had shown up on my Experian report. It has not shown up on any others.

I've disputed it with Experian stating that I had requested validation which had not been received and I'm waiting for the results of that investigation. I thought of sending another letter to the CA advising that I am aware of their illegal activity requesting the item to be removed until it can be validated.

Any thoughts?

Hi Avon,

If the collection agency reported the item after you sent them the debt validation letter then this is violation of the Fair Debt Collection Practices Act. You can file a complaint with the Federal Trade Commission and the State's Attorney General about this.

You can then dispute with the credit bureaus as you have said.

Hi Avon,

Another thing that you should do about this debt is check the last payment date. Then check the Statute of Limitations (SOL) on this debt. If the SOL has expired you can directly dispute this item with the credit bureaus.
