Out of state assets

Hi,

I reside in California and have credit card debt and I may be soon get sued for that here in CA.

However, I own a property free and clear in New York state. Can creditors attach lien to this property before suing or after obtaining a judgment against me? Will they even be able to discover this asset of mine?

Hi Terry,

Lien can be placed against your property only after a judgment gets issued. However, if they can find out what assets you have in another state will depend on your creditor itself. Also, even if the creditor is bale to find out your out of state assets, whether or not he can put lien on it will depend on the state laws.
