After requesting a Debt Validation I received a letter from an attorney that stated 'debt verification.' All it is is an affidavit from someone who works with the debt collection company who is seeking to collect a debt. The affidavit does not have the original contract with the original creditor or does it show how they obtained this account. How should I respond? I have ten days to do so.

Hi lkgibbs,

Welcome to this community :)

I think you should consult an attorney regarding this. However, you had asked for debt validation and this is not at all a proper debt validation. You can file complaints with your State's Attorney General and Federal Trade Commission.

Thanks,

Aaron

DV= whatever a judge says it is. And a contract may not be necessary. however, the records are supposed to come from the OC. usually statements.

do you have all your credit reports?
what state are you in?
what is the original creditor and the name of the CA?
what is the date of first delinquency? 30 days after last payment

Hi lkgibbs,

I think you can visit the court as a lawsuit has already been filed. Request the court clerk to provide you court papers on this lawsuit. You will get to know if this debt is valid or not.

Thanks,

Aaron
