Midland Credit Management Refuses To Validate!

About 3 ½ years ago I found a listing on one of my credit reports listing a debt from Midland Credit Management and this was the first time I heard of them. Over the past 3 years I have sent Midland Credit Management 3 DV letters (all certified, with return receipt) and they never sent a single reply to my request. I have sent a letter of intent still no response from them? I even sent them a offer to pay for delete and still nothing? In the last 6+ months I have learned they have no supporting documentation, Just a list of alleged charges and a account number, I was also told the account was purchased from an (unnamed) third party, the original creditor is supposed to be Aspire Visa. When I contacted Aspire Visa I gave them the original account number Midland gave me (not the Midland account number) along with my full name, SSN, and DOB and Aspire told me they could NOT find a account in their records belonging to me? I told Midland what Aspire Visa told me, and was told that did not matter they NEVER would check with the original creditors, that it was against their policy? On one of my TransUnion reports it shows it to remain on my report till May of 2013 which indicates the account is 4 years & 9 months old (the Utah SOL on this kind of debt is 4 years). And now Midland says they want me to fill out a FTC fraud affidavit and to submit it to them (Midland), my problem with that is it would give Midland my Full Name, DOB, SSN, Where I have been living for the last 5+ Years along with my signature, and they have a record of committing fraud making false docs to use in courts. And to boot I have no details on the account other then that I got talking to them on the phone. And around the time the account happened I was drinking alcohol a lot and can’t remember much from around that time. So I can’t remember if there ever was a account.

What should I do at this point? This “Open Collection” is the only thing keeping me from getting a home loan! If I just pay them that would make my score drop and still not be able to get a home loan, Plus be on my credit report for the next 7 years. Someone please help me, I just don’t know what to do. Don't give Midland anything but the info already on your credit reports. File a complaint with your attorney general sending copies of your green card.

Also file a complaint with the OCC against Aspire Visa. I believe your are saying this is not your account. the complaint will allege that they are not taking proper care in verifying applications and trying to collect from you fraudulently.

Aspire Visa said they don't know what Midland is talking about. And even sent me a letter Stateing they have no record of the account number or any account matching my name or ssn.

Ok then send a copy of this letter to the CRAs and ask how they are verifying this. It is a MOV letter.

I would also send a copy of this letter to your Attorney General.

Yes, you may get it verified with the CRAs.

We have an issue with Midland as well! And the CRAs keep "verifying" the debt. It's listed on all three of my husband's reports and the balance on each is totally different and not one is even close to the original creditor's balance. I disputed it again with TransUnion for the 3rd time on Jan 28, 2011 and am awaiting results. If it comes back verified again, I will be sending a validation letter, and if they ignore it, I will be forwarding my info with a 4th dispute and demand for deletion to all 3 bureaus.
