Filing bankruptsy

I filed bankruptsy in September of 2000. It was discharged in January of 2001.
I was wondering if I can file agian with the new law. I was told that since I filed in 2000, that I could file, because I filed BEFORE the new law.
Please let me know cause am so stressed out and I am tired of worrying all the time.

I am not sure how often you can file in years. I don't know much about the new law. I would think they would put some type of limitation in it because people would continually do it. I am not real sure, maybe someone will come along that knows more about it. It has been a few years since you did it, so maybe you will be okay. Did you google it and see if you can find out anything about the new law in place. I would call an attorney that deals in bankruptcy and ask them, they should be able to answer that question over the phone with no cost to it. goodluck, hope everything works out for you.

Yeah I know they did and I understand that. I really did not plan on ever getting into this mess agian. My hubby and I have had bad luck. He got hurt at work, and it was eight in the summer when I am on summer vacation from the school i wirk for, i wirked summer school but still i have off for a month before and a month after summer school before regular school starts. I even got a second job too but still had money issues.

I think what good is trying to say is that you probably need to call an attorney and he or she can give you the answer right over the phone. I am sure they would too and that is what I would do if I were you. The law is not for a layman to understand, especially if there is a bankruptsy already in your history.
There may be some one come along who has a better understanding of the law, there is also the debt forum that you can access at the top of the page, there is alot of information on that forum about this subject, so for immediate help maybe you could try there. Hope this is helpful.

I talked to a Lawyer today and they told me that i would have to wait until Spet 2008/ Sp chapter 13 will have to be what i do. I hope i qualify. I took a internet means test and qualified for the chapter 7, i wonder if I can for the 13

In case of chapter 13 you need to have the capability of paying off a certain amount of the debt.

Well I work full time and my hubby wroks part time so we both have a job. What hurt me was all the payday loans over the summer when we were both not working. He got hurt and i was on summer break. I did get another job for that time but still one paycheck short,

Try to save as much as possible. Dump all the petty unnecessary expenses. I hope you will be able to pay off the loans easily.

Try out this....when you get your paycheck save an amount which you ill have to forget completely that you earned. Pay the debt off. Then with the rest of the money continue with all the other payments.

Well I did not file i just paid off like 4 places, and one of my hubbies still have some to pay off but they will just have to wait. i will pay them off one at a time.

Its really good that you have been able to pay of most of the debt that you owe. Keep up with the payments and you will see the difference in the credit score.

It depends on the type of bankruptcy you want to file. If you want to file a Chapter 7 bankruptcy, you need to wait for another 8 years before filing a second one. Now since you have filed a bankruptcy in 2002, you can file another Chapter 7 bankruptcy only in 2010. However, you can file a Chapter 13 bankruptcy after 2 years of filing of the first Chapter 13 bankruptcy only if it has been discharged.
