asset acceptance has started garnishing my checks and i just found out on pay day. what do i do

Hello! I recevied a debt in Columbus OH for breaking my lease in my old apartment in 2009. I moved back to Pittsburgh PA in 2010 and work in PA and are having my wages garnished for it. Is this allowed?

In Michigan they can send a letter regular mail to your home and it's considered legally served. Many people make the mistake of thinking that you have to physically sign to be served- in Michigan that's not true. The court can throw a 50 cent stamp on a letter and mail to your address and that's legally serving you.

I had a car that was repossessed back in 2001, never heard anything after that, I moved across the nation in 2004, still never heard anything, moved back to California the end of 2010, I checked my credit report the beginning of 2011 and there was nothing on it. Now as of yesterday, I have received a notice from my work that my wages are going to be garnished. Is this legal???

i had a car that i bought that my husband cosigned for & it got repoed, so now they are telling me i owe at least 5,000 dollars, well im not working and we only have one income. so i got a letter in the mail talking about going to court i didn't fill it out i called n made an agreement to make payments of 87 dollars a week since that was my regular car payment, mind you my husbnad bought a car from this same place as well. so months go by i was unable to make the payments they sent me another letter so i made another agreement to do more payments. that started back up n august 2011.i stopped paying october 10, 2011. i stopped because im was pregnant n did not work n we still have one income. so i called today and found out they put a judgement on my credit which is fine n i let them know i have no income so now they arfe telling me that they are goin to come after my husbands wages. is there anything i can do to stop them from taking the only money that we have?

the hospital garnished my wages the bill is my ex's that i didnt even co sign for. now is this legal in the state of kansas?

I am geting garnishee I never received a notice or later
only letter I received is from my job saying I am going to be garnishee what can I do to stop this

Back in 2001, I had my bank account wiped out (and overdrawn) by a credit card garnishment. I was never notified to come to court, although they said they did via summons. The address they said they served papers to was an address I had never lived at. I hired a lawyer and the money was ordered to be returned to my account. Now (in 2012), the same company has garnished my wages at work. Again, I was not notified or did not receive a summons to court. They just sent a notice to my employer who told me it would come out of my next paycheck. Both times (in 2001 and 2012), they had a court order for garnishment, but as I said I was not notified or made aware of court either time. Did they do this illegally again? I am in the state of Missouri.

I had a car financed through Household Automotive Finance Corp. who was located in California, the car was through Roger Whitley Chevrolet, a car dealership in Florida, in 2008 Asset informs me that this finance company had passed a judgement against me, knew nothing about it never got notice to go to court, and they say if I don't stick to the payments each month they can take me to court without me being there and have me sued. this car loan was back in 1997 to 2000

My salary started being garnished this last pay period. I was not notified by the Lawyer firm suing me, or by the court or my employer regarding this garnishment. It just hit my paycheck for a total of 402.00, which they are now taking each pay period. I can't live off of the reduced amount. Since I was never advised of a court date, nor a judgement, do I have any recourse regarding this wage garnishment? I can't afford a Lawyer, either.. I am at a loss of what to do.

Yvonne ...please do not double post. I answered your question in the thread you started.

Shawn...did you get a summons?? Did you respond to it? If so and you failed to respond, you are stuck with the garnishment. If you did not receive a summons,go to the county court website that has the judgment and lookup when and where you were supposidly served. You will need to motion the court to set aside the judgment for lack of service. However if this is a valid debt, the creditor could just turn around and service you again.

my check is being garnished at this time for an amount of 11,700 and i never received notice about any garnishment or never went to court how can i stop this garnishment.

credit acceptance put out a judgment on me and now they garnishing my wages they say I owe 6000 for a truck I had. Is it to late to try to make some kind of settlement with them? Are should I get a lawyer and let them do it?

Myself and co-signer recieved a msg saying we are being served for a debt I have for about $5000 on a card. I am unemployeed, no income, and my co-signer is retired and gets pension and social security. If and when there is a court order, could the ceditor garnish my co-signers bank account in which she recieves her pension and social security? Thanks for the advice in advance.

Hi. I live in FL . my bank account got garnished on January 19th, 2018 ( checking and saving ) when I called the bank they said I had to call Asset Acceptance. They are claiming that they serve me on August 2011 and gave the papers to my daughter ( 21 years old ) but I was out of the country from July 2011 and came back on Dec. 2012 .
I didn't show up to court. after 6 and 1/2 years they decided to freeze my bank account ??
I went to court and fill out the paperwork for a hearing claiming that I never received the papers , I have a court date For this coming April 6th , 2018 .
I have proof that I was out of the country but I don't know what else I can use as my defense . They still have $ 2,000.00 on hold from my saving bank account .
That anybody has some advise ?
