Can Social Security and retirement income be garnished?

i can't pay my credit card bills, what can they do to me? They sent me a letter saying if I dont pay they will get a judgment and do so. I thought that retirement income source and Social Security income couldnt be garnished? Can a credit card company garnish my wages?

My Mom is retireing in July 2010 and will recieve a Social Security check and a Retirement check from the State of Nevada. She co-signed a loan for a motorcycle for my Brother-In-Law and he lost his job and they repossessed the motorcycle earlier this week and he is filing for Bankrupcy. Can they garnish my Mothers Social Security or Retirement? What if they are automatically deposited into her checking account? Thank You

I cant pay my debts to credit card companies. I just got a law suit from Suncoast schools credit union and they want over 12,000.00 back. I have 2 daughters and we lost our home last year. We are staying in my mothers rental. The only thing I own is my car which is worth probably 8,000.00. My mom bought me that last year after I lost everything. I'm not even getting child support from a dead beat ex- husband. I just got my counseling certificate to claim bankrupstsy but I can't afford that either. Main question. Can they take my car?

I cannot make the min. pymt. on my credit cards since I lost my job, I read somewhere if you send your cc companys some sort of payment and they cash it this means they have excepted the terms...is this correct???

Hi Kristy:

Under the federal law, social security income cannot be garnished. One thing that your mother can do is open a new account in another bank. She should also inform the bank that, her money comes from social security. This may help.

There is no specific time limit within which a credit card company may write off a debt. It varies according to the company, and according to the debt. However, they generally write it off, when they realize that they won't be able to collect the amount owed, from the debtor.

If you do not make a settlement with the company, and yourself get a written copy of the contract, the company may come back and demand more money or the deficit amount from you. Therefore, it is better to get a written contract of the settlement. While settling with the company, mention that you want to pay, but won't be able to pay such high amounts, because of your financial problem.

I live in Texas and have social security and a part time job which pays me $300 a month. I only have enough money to pay my living expenses and cannot pay any of my credit cards which are over $10,000!! I have been sued and cannot afford an attorney. What should I do? Thank you!!

I have a possible judgment being filed against me for an outstanding credit card balance and all the income I have come from my child support which I receive direct deposited into my checking account. I do not work. Can they garnish my child support payments that I receive?

Hi Marion,

You don't need an attorney to deal with the case. However, you can go for a free counseling with an attorney, for dealing with this case. You should appear in court, and provide them with a copy of your monthly income and expenditure. This will determine the judgment amount. Your social security cannot be garnished. However, your wage is garnishable. At least 25% of it can be garnished. It also depends on the type and amount of debt.

However, you can try and settle the debt with the creditor itself. Debt settlement lowers the outstanding debt amount by 40-60%.

Hi Gee,

Somebody's wage or account, who is supposed to pay for the child support, can be garnished. However, if money accumulated into a checking account as child support can be garnished or not depends on the state laws. As such, checking accounts are garnishable.

However, if your state allows no garnishment on child support account, and you can prove this to the creditor, they may not be able to garnish money from your account. The account should have money only from child support.

My mother is 76y.o. and get a social security check and a Virginia state pension which is not much of anything. She has a trailer and can no longer afford to keep up the payments and wants to move in with 1 of us kids. Can they garnish her wages for the trailer payment? She is struggling and does have a direct deposit account but all the income in it is social secuirty or pension?

Retirement payments are not garnishable. However, you need to check the state laws on this. Moreover, if you can prove that all your money comes from retirement payment and gets deposited into that account, they may not be able to garnish your account.

I have a question about not paying credit cards. I just sign up for this forum and hopefully u guys can answer my questions. I have few credit cards some of them limit is 300$ some of them 2000$ . my total debt on all of them is not more than 6000$. I was paying my bills always on time-never late for-6years. lately my financial situation got very bad and im not able to pay anymore. I was plannig to do bankupcy but this cost money too :( which i obviously dont have. so my 2nd plan is to not pay at all because i dont have asets anyway. i just dont want collectors to bother me.
i guess i didnt mention that i dont even have ssn # and i got credit cards. i dont have status in usa yet. so i was wondering if they can be really after me if i dont legaly exist here??
I dont want to do that but at this point I dont have any options. I can bearly make it with energy and rent bills. I found some work for cash but its just enough to survive month?Pls help

Hi Wralph,

Under the Federal Law, Social Security Benefits are non-garnishable. No body can garnish your account, other than the Government itself. However, you need to declare that, all your income comes from the Social Security both to the bank and the credit card company.

The creditors and collection agencies can take your money from the joint account. You can take your name out of the joint account, and open a new account in your name only. This will help.

what do I do. I have a letter stating that a judgement creditor against me dated 9/1/04 this was snt to me 3/3/10 stating I have property not exempt frpm being taken. I have a court date in April.

I don't have a car, bank account with more than $50 in it. I work & bring home about $150 a week.

The last payment was in 98 or 99. Not aware of anything on 9/1/04
per court order.

What do I do.

You can take the help of an attorney regarding this. However, generally speaking, social security cannot be garnished under the rules of Federal Law. Still, you need to check your state laws on garnishment and social security.

As you have got a judgment, you need to appear in court on the mentioned date. Can you tell me, whether or not you received any notice on the judgment before this? If the account is only in the child's name and if the creditor is not aware of this account, they may not be able to garnish your child's account.

Military retirement pay and Veterans Administrative income (VA) cannot be garnished. But there are exceptions. The VA disability received in return of waived military retirement pay is subject to garnishment. This is done in order to provide child support and for alimony purposes.

Sally:

If you fail to pay what you owe to a creditor, the creditor can file a judgment against you. The judgment can either be for garnishing your wages and bank accounts. The judgment can also put a lien on your property. Thus, it's better to pay off what you owe to the creditor. If you are unable to pay the whole amount, you can settle the outstanding debt amount to be paid. Debt settlement lowers the debt amount by 40-60%.

Marty:

If the bill amount is too high you can try to negotiate a payment plan with the creditor. Talk to them about your problem. Mention that you are willing to pay, but it's not possible for you to pay high amount bills. However, as you have received a summons, you need to answer to that. If you face problem in answering to the summons, you can take help from the court clerk. In the answer to the summons mention your financial condition.

I had a business and I just closed it........no bankruptcy. I had 2 cc and was no longer able to make payment on them, as I went through divorce after closing the business.
I have a rental (am not delinquent on payment...rent is less than the monthly payment) can the card company seize my property?
I rec'vd a letter judgement in 1/10 at my home residence and today my
renters recv'd a garnishment summons.
Can my rental/mrtg. payment be taken, it doesn't cover the 1st and 2nd mrtg.? Can they seize my property?
This is driving me crazy.......

What you can do is open separate accounts for the social security and money that comes from stock market. Use the money that comes from stock market, and save the money that comes from social security. our bank took all my social security and my ten year old grandsons ssi,who is disabled and under my custody. i had a lot of creditors so I went to a consolidator and signed up with them. they were working on negotiating a payment for me and when they used electronic transfer of the account, it was closed. I notifed the bank and opened a new account there. They knew exactly how I was handling this situation. they (one employee) opened my closed account and used my monies to pay these creditors. leaving me $10.86 overdrawn and with no money for the entire month for food, medicine, or anything. This also voided the contract that the other company had with some of the creditors getting paid in full and other not at all. We contacted everone including the CEO of this bank and they said they couldn't do anything I filed a complaint with the FDIC and they forwarded it to the OTC which is where it is now.
PLEASE TELL ME THIS WAS WRONG AND AGAINST THE LAW TO DO?

Hi Care,

Social security cannot be garnished by anybody other than the government itself. If you find that your social security has been garnished you can take help from a lawyer. If you don't have much money to afford a lawyer, you can consult American Bar Association. They will help you find a low cost attorney.

Other than this you have taken the right step by complaining this to the FDIC.

In Florida, according to the Federal Law, the wages of the head of the family cannot be garnished. Thus, if you are the head of your family, you wages may not get garnished.

The bank where my husbands S.S., my S.S.D., and his pension from the state are direct deposited, gave him 3 credit cards totaling $23,000.00. Now payments are not manageable anymore. Know they cant' take S.S. or S.S.D., but can they take Indiana state pension? Bigger question is, why would they give credit cards knowing our only incomes are the above? Thank you.

If the debt was included in the bankruptcy, you may not have to pay the dues anymore. Any debts included in the bankruptcy, remains noncollectable, even after the discharge of the bankruptcy. If the creditor is still calling you for the payments, you can inform them that this debt was included in the bankruptcy. Thus, there is no fear of getting sued for this.

However, if this debt was not included in the bankruptcy, you need to pay that off. Otherwise, you may get sued or your car may get repossessed.

Mrs B:

Nether Social Security nor pension can be garnished. However, you need to declare to the bank that all your money comes from Social Security and pension. As for the issuance of the credit cards, the bank is concerned with their own business. It is their job to issue cards. If you were aware that you will not be able to pay, you shouldn't have taken the cards.

Hi. I just turned 62, am on early retirement in Wisconsin. I get $475 a month alimony from my ex, part of his pension from a divorce court-ordered QDRO of $520.17 a month. My SS will be from taking some of my ex';s work credits, because I never worked but 2 years in my life. I am to start getting $721 the second week in April 2010. I have Credit Card debts from using them for living, because I was only getting that $995 a month. I have a car that I pay $305 a month on, and I still will pay that. I rent for $710 (split with roommate), and I will comtinue to pay that and my phone & electricity. I own nothing of value, just my clothes and a few older things (electric). My computer is on one of the Credit cards, and I would continue to pay that. I just have 3 cards that I cannot afford to pay any longer on. I don't want to go Bankrupt again. I did in 2000, and I only have this debt because of having to live. Can they garnish my court-ordered pension from my ex? Or 'any' part of my SS? Or my alimony? There are only 3 cards, and they total $9,500 total (roughly). I am only paying minimum payments now, and let's face it. I probably won't live for 20-some years to pay them off. I am in bad health, cannot see a doctor because I have no health insurance. I can't even afford food. I go to Food Pantries. If you could help me on this, I would appreciate it, because I have no extra money to hire a lawyer. My Illinois friend says that I can just stop paying them. I will get nasty calls but that they will stop after a while. She said I can do an do an "informal" BK by simply just stopping paying on the debts." I, personally never heard of this. Is this an Illinois thing? I owe now taxes to the government, no medical bills or hospital bills. I rob from Peter to pay Paul every month and hand-wash my clothes and put them on hangers on the shower rod.
