What are my rights served a summons credit card debt

Submitted by Anonymous (not verified) on Sun, 06/17/2012 - 02:58

I live in Arkansas. The other day I was served a summons for credit card debt from Hosto & Buchan in the amount of $7561.36 for Capital One. I am not denying that I owe a debt to Capital One but due to financial issues I felt it was more important to pay my house, utilities, car, food etc. than to pay credit card bills. I have more debt than this one credit card not sure exactly how much but its probably in the $16,000 range. I can't believe I racked up so much debt if this economy wasn't so bad I probably wouldn't have.

Okay, not sure if this will help, but what the heck, I am a married father of three, one with autism, been at current job for 9 years work everyday of my life with 20,000 a year in overtime. I purchased my dream home in 2005 and lost it in the collapse to a short sale. Moving in my current home for the last 4 years renting and found out my landlord claimed bankrupcy and is currently short selling the property, unfortunatlly my credit is not there yet in that I have the only income in houshold and medical expenses besides.

Hi,

I'm hoping to find some advice please?

I have about 12k debt all accumulated when I was married and my wife was off ill for a number of years. The debts are in my name and due to the marriage ending because of aggression I never argued over who would take responsibility for them - I just wanted out as quickly and easily as possible.

Submitted by trixie on Thu, 03/01/2012 - 22:32

LNVN sent me a letter about 1 1/2 yrs ago and I sent them 2 DV letters. They sent back a short paragraph stating an amount etc but no copy of an OA from the CC company that owned the debit originally. Now I see them on all three of my credit reports. Can they do that without proving to me that they own my debt??? What do I do now? Any help greatly appreciated please

2nd Mortgage ?

Submitted by Anonymous (not verified) on Tue, 01/24/2012 - 07:39

Good Evening all,

I went through a divorce 2 years ago, the house went into foreclose. Anyhow the 2nd mortgage was "charged off", I received a letter from a collection agency tonight.
My question,
I'm sending them a VOD request as I do not recognize the name it says is the debtor we had the 2nd with. Do they need to provide, the original creditor? Do I ask for signed copies with my name and my ex's?

Recieved petition for written answer to court summons

Submitted by bholloway2275 on Wed, 11/30/2011 - 03:59

I received a court summons stating that I need to respond with my written answer to a petition filed on behalf of Portfolio Recovery Associates. The original creditor has written off the loan and it must have been purchased by Portfolio. The person with the summons, said I could call and work with the people listed on the summons to work out payment, and that I needed to answer the petition. I know I need to answer the court, to avoid a judgement, but what kind of things do I need to put in the letter.
