judgement from CMRE for medical bills need advise

i need a letter or something to send to CMRE they filed a judgement lien im laid off my job and can't have them taking my stuff i thought i was still working with them on this apparently not

Hi bttb,

As far as I know, a judgment lien is imposed on your property, if the court feels that you will not be able to pay your debts. The debt can be recovered by putting a lien on your property. You will not be able to sell your property without paying the debt amount. The only way to remove lien from the property is to pay down the judgment amount.

Were you trying to settle debts with CMRE before they filed a judgment lien? Or are you trying to dispute the debt?

yes the lien is imposed on our property for 1241.75. it was for a procedure my husband had and his ins was supposed to pay it all and didn't claims that the org. amt of 748.80 was his deductable NOT his was met long before this. org date 9/07. I contacted the hosp. as soon as i rec'd the first inv. told them we were disputing it, explained the whole thing and I would contact them back or have the ins co do so asap. that was 10/07. ins co said oh sorry resubmit. called hosp billing dept said resubmit they made a mistake. didn't hear anything else from the hosp. Called them end of Nov billing said no open inv checked online at ins co no outstanding funds owed!!!?? 1/12/08 Hosp sends another inv asking for 748.80. WHAT??? called hosp billing spk to Supervisor (or tried to) she said can't talk to me wanted to know who i was HIS WIFE and yes you can talk to me he had all that paperwork done when he had the prod. just in case besides I handle all that med stuff anyway (was my job for 18yrs in a hosp) So he filled out the papers for them to talk to me had them noterized hand carried to acct dept along with the info stating paid in full from them as well as ins co. on 1/14/08. and here goes the ride back and forth yes we paid no we didn't next thing i know 10/08 i rec a letter from CMRE Fin. demanding payment or they are going to sue first letter from them. called the num on the letter spk to Ben said jumpin the gun there aren't you been what happened to the collection agency in between the hosp and sending it to a lawyer requesting a lawsuit.. long story short i faxed all the info to CMRE attn ben along with playing phone tag for a year. I never once said we wouldn't pay the darn thing but i was not going to pay for something "A" we didn't owe and "B" they couldn't figure out if it was pd or not by the ins co. my god i would have never gotten my money back. they said they served my husband at our home??? Really? Ben says yeah knocked on the door asked for Gary the guy said yes and he was handed the summmons. Well I said didn't the process serv think my husband was rather good looking for his age for godsake that was my son his was only 14yrs old my husband is 59! and yes his name is Gary "JR". Now we have a lien and both of us are laid off last thing i need now is to lose the house or something. Can i contact CMRE and try and set something up to pay and then I am still fighting with the ins co. over this. everytime this happens i have to start all over with someone new. what a racket this is. what can i do!!!???

Hi bbtb,

You should contact CMRE Financial Services and propose an out of court settlement. Tell them that you do not want any further involvement of the court, as you are ready to pay off the debt amount. But first you should ask for a debt validation. You will find a sample Debt Validation (DV) letter in the Letters of Credit section.

If CMRE is able to validate the debt, you should negotiate for a settlement amount. Sometimes it is possible to reduce the debt amount by 40-60%. In case you do not hear from them, within 30 days, after receiving your DV Letter send them a Debt Validation Follow Up Letter.

Still if there is no reply from collection agency, send them a Cease and Desist Letter. You will find a sample Cease and Desist Letter if you visit the following link: http://www.creditmagic.org/repair/cease-desist-letter.html . After receiving this letter they should cease all contacts with you. You are not liable to pay a debt, if the collection agency cannot validate your the debt.

Hi bttb,

If the collection agency is able to validate the debt, before making any payment you must check whether the debt is within the Statute of Limitation period. The SOL period depends on the whichever state you live in.

I would suggest, if the debt is very close to completion of the SOL period, do not pay it. Making any payment will cause the SOL period to restart. After the SOL is over you can dispute the debt with the credit bureaus and get it removed from your credit report.

Hi Scott,

I feel that if you receive any call from a collection agency, you should first check whether the debt is within the SOL period. If the SOL period is over, and the CA continues to call, you can send them a Expired SOL Notification Letter.

Even if the debt is close to the SOL period, it is better to not ask for debt validation. When the SOL period of the debt is over, you can send a Dispute Letter to the credit bureaus. The credit bureaus will investigate and update your credit report.
