Am gong bankrupt but owe a card 9,000 which I thought was under my name as holder but it's under husbands and he has no idea of the card. His moved out and before I told him I owed on credit cards and wanted to go bankrupt he said No. That he never got a card and didn't owe anything. If I don't pay will I go to jail or what will happen if I can't pay the card? I can't even find a Job. I live in CA. USA. But when he lived in the home he would use that against me if you don't do this I wont help you with your problem which he meant the bankrupts.

Non-payment of debt is not a criminal offense. It’s a civil case. So, you can’t go to jail for that. If you owe this debt, then the creditor can file a lawsuit against you because of non-payment of debt. If you don’t owe this debt, then the creditor can’t do anything. I think you should consult with a financial counselor in this regard. This is because your situation is really very complicated.

Am trying to pay it off but can't make the payments any longer. Like I said I thought I was the holder but my husband is. Am just worried I don't want issues.
