Hi there. My wife and I received a Writ of Execution making several statements about "levy". I am trying to figure out if I do not respond, do they start taking money from me? We have other cases in court right now, and have not seen this form before. I am confused if this is a step before motion of periodic payments, or are we beyond that?

Hi Phisher,

A writ of execution is the authorization given to the judgment creditor to seize assets of the debtor. If you do not answer to the writ, the court may issue a Contempt of Court Order against you. Thus, it is better to answer to the writ. What you can do is, remove money from your accounts, so that the creditor may not be able to take away all your money.

Thanks,

Aaron
