Ask them to validate the debt in writing via certified mail with a return receipt request. If they don’t give any reply then send them a Cease and desist letter.
The FDCPA places no time limit in which they must provide the requested debt verification. Their "penalty" for not providing verification is that they must cease collection on the debt until verification has been provided.
HSBC reported that I paid twice after I didn't make any payments I was told they can be fined 1000 for that but idk what to do.
I last paid in December 07 HSBC reported I paid in January 2008 then again in August 2008. Spoke to HSBC or capital one now the recovery dept said payment wasn't made by me that it was the company that purchased the account when it was charged off. Anyone experience this?
My balance always remained $1964 even with that supposed "payment". HSBC reported I made a payment. The recovery rep is mailing me the last statement dated August 26 2008. I actually have all my statements except that one. Weird. Anyone have any ideas or suggestions ?
Today spoke to the recovery dept and the girl said they had a statement dated August 26. The account was charged off July 31st which confuses me but she said she'd mail it to me. She also stated that "payment" made wasn't by me that she believes it's from the person that purchased the account cause the amounts were equal.
The law office says to contact HSBC for proof of payment. HSBC says contact the collection agency. So Im probably going to send HSBC a debt validation letter.

I have a 535 right now and i have a card that is maxed out. Its the only CC i have and im wanting to pay it off. I need to get to 580 score to get this loan for my business and this is really the only thing that can change on my report that i can do anyway.
Otherwise i have a few medical collections some i did get removed but i still have some on there.
Its a $500 card and if i paid it completely or almost all of it. I am curious how much this could raise my score.
I sent a validation letter to MCI on May 25, 2012 (certified) quoting the Fair Debt Collection Practices Act and asking that they stop collection and reporting until they validate the debt. NO RESPONSE. Then on June 25, 2012 they reported it to the credit bureau and then reported it again on July 5, 2012. I have no problem paying as the debt is only $81 but I would prefer a pay for delete........especially given how frequently they report. I believe the debt is showing up under MCI and then again under a CA. What should my next step be?
After reading your post, I'm assuming your dad is NOT on the debt. If not, the CA made an illegal attempt to serve you. I'm not an expert, however, I can tell you MY experiences with CA's. First of all..don't call them. I would send a letter asking for validation. A CA has so much time to validate a debt with you. Second of all..see if the debt is possibly on your CR. there is such thing as SOL and you need to find out what that is for your state. ALL states have different SOL (Statue of Limitations).
